Brownfields



“Brownfields” are properties that are compromised by the presence or suspected presence of environmental contamination.  In many states, beneficial regulatory and tax advantages flow from redeveloping such sites, providing real economic opportunities.  Our attorneys advise and lead public and private developers through all phases of Brownfields redevelopment, from initial investigation of contamination through cleanup and construction.  The Real Estate group employs a multidisciplinary strategy utilizing the firm’s expertise in land use, transactional real estate, environmental, tax, insurance and finance.  Our attorneys have extensive experience in entity structuring and complex joint ventures, managing technical consultants in site investigation and remediation, negotiating with regulatory agencies, securing Brownfields tax credits, analyzing available insurance products, and utilizing today's sophisticated financing techniques.  In addition, we advise developers on high performance “green” development, and provide advice on the availability of federal and state government funding, including tax credits under Green Building Tax Credit Programs.
